Terms of Service

These Terms of Service ("Terms") govern your use of Noisely, the Noise.ly service ("we", "us", or "our"). By using our service, you agree to these Terms.

1. Service Description

Noisely is a brand monitoring platform that aggregates mentions and reviews from various online sources. We help businesses track and analyze customer feedback across multiple platforms.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use our service.
• One person or legal entity may maintain only one account.

3. Subscription and Payment

• Access to Noisely requires a paid subscription at $49 per month.
• Subscriptions are billed monthly in advance.
• Payments are processed securely through Stripe.
• Prices are in USD and exclude any applicable taxes.
• You authorize us to charge your payment method on a recurring basis.

4. Cancellation and Refunds

• You can cancel your subscription at any time, with no hassle, directly from your account settings or the Stripe portal. There are no cancellation fees and no need to contact us.
• When you cancel, your subscription stays active until the end of your current billing period, and you keep full access until then.
• We do not offer refunds. All payments, including for partial or unused billing periods, are non-refundable.
• Because cancelling is always quick and easy, you stay in control: cancel whenever you like and you will simply not be billed again.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated means to access the service beyond our provided features
• Resell or redistribute the service without our permission
• Use the service to monitor brands you do not own or have authorization to monitor

6. Intellectual Property

• The Noisely service, including its design, features, and content, is owned by Noise.ly.
• You retain ownership of your brand information and any content you create.
• Mentions and reviews collected are sourced from third-party platforms and are subject to those platforms' terms.

7. Third-Party Integrations

Our service integrates with third-party platforms (Google, Trustpilot, Reddit, etc.). Your use of these integrations is also subject to those platforms' terms of service. We are not responsible for the availability or accuracy of third-party data.

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform maintenance that temporarily affects availability.
• We reserve the right to modify or discontinue features with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for decisions you make based on data provided by our service.

10. Indemnification

You agree to indemnify and hold harmless Noise.ly from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Termination

• We may suspend or terminate your account for violation of these Terms.
• Upon termination, your right to use the service ceases immediately.
• We may delete your data 30 days after account termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia, unless otherwise required by applicable consumer protection laws.
